This year’s Special Project, organized by SIC, stands as an opportunity to emphasize challenges and perspectives that not only reflect the effective and efficient application of free economic competition rule in Creative and Cultural Economy, but, in turn, an opportunity for Competition Authorities to evaluate and reflect on new methodologies and tools that encourage innovation, considering the implications of this sector in terms of consumer rights, industrial property and economic competition. This panel seeks to determine if the current regulations and quantitative analysis allow to efficiently articulate the incentives for the cultural and creative entrepreneur and the creation of an enabling environment that facilitates innovation, without ignoring the importance of strengthening free economic competition and consumer rights defense.

Ten years after their approval, the ICN Recommended Practices on Assessment of Dominance/Substantial Market Power still reflect significant convergence on several fundamental and critical principles of unilateral conduct analysis – including the use of a sound analytical framework firmly grounded in economic principles to determine whether dominance/substantial market power exists. This panel will explore new challenges in the assessment of dominance in light of recent developments in the digital and high tech sectors.

This Plenary will discuss various policy choices and ways that serve the fight against cartels. The panelists will share their stories in relation to whistleblowing, ex-officio investigations, leniency, settlements, fines and individual sanctions. In this context, they will share views on the following topics: What are the detection strategies and enforcement tools that agencies should apply in order to boost their anti-cartel enforcement record? What is the optimal mix of public and private anti-cartel enforcement? How can agencies uncover and punish cartels especially in the digital era?

Plenary Sessions - Proposed Topics/Formats

AWG Topic: The Art of Advocacy – Sun Tzu’s Strategies and Tactics for the Competition Advocacy Challenges of Today and Tomorrow

Format: To make the discussion entertaining and something the audience will remember, the discussion will be framed based on the strategies and tactics of Sun Tzu's Art of War. The panel will discuss how the strategies and tactics can be applied to make competition advocacy effective and powerful to meet the challenges of today and be future-ready for tomorrow (e.g. Industrial Revolution 4.0, rapid changes in the media landscape, etc.). Prominent speakers will present insights based on their experiences and concrete examples under the heading of some of the famous Sun Tzu's strategies and tactics; for example:

  • “Strategy without tactics is the slowest route to victory. Tactics without strategy is the noise before defeat.” – linked to the Advocacy Strategy project
  • “If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.” – linked to the Competition Assessment project
  • “In the midst of chaos, there is also opportunity” – linked to the Advocacy and Digital Markets project

AEWG Topic: Effectiveness Through Organisational Design

Inspired by the AEWG’s report on organisational design, this plenary will discuss the pros and cons of different organisational design options available to competition authorities. For example, how can authorities be organised to balance flexibility with organisational stability? Are certain design structures more suited to encouraging effective quality control of investigations? What are the pros and cons of sector-based units as opposed to units based on area of law being enforced?

Format: The plenary will be structured in a debate format in order to illuminate pros and cons of different models and demonstrate how different choices can be appropriate in different circumstances, recognising that there is no one-size-fits-all solution to these questions.


CWG Topic: Deterrence & Enforcement.

Format:Interview style plenary panel, with questions prepared in advance that could be focused on pre-identified themes of detection and enforcement.

MWG Topic: Merger Review in the 2020s: Do Digitalization and Globalization Change the Analysis?

Format: likely based around a ‘hot topics’ Q&A format to address several key topics in separate, quick-fire segments. (for example, acquisitions of digital start-ups or analysis of non-price factors & innovation or global remedies – please note that these ideas are provided as examples, no decision has been made as to specific segments of the panel)

Format: Discussion of controversial statements, so to solicit opposing views among the panelists.
